1. Scope

These Terms of Sale apply to all orders placed through our online shop DarkMerch (www.darkmerch.com).
Any differing terms and conditions from the customer are not recognized unless expressly agreed to in writing by DarkMerch.

1. Geltungsbereich

Diese Allgemeinen Verkaufsbedingungen gelten für alle Bestellungen über unseren Online-Shop DarkMerch (www.darkmerch.com).
Abweichende Bedingungen des Kunden werden nicht anerkannt, es sei denn, DarkMerch stimmt ihrer Geltung ausdrücklich schriftlich zu.

3. Conclusion of Contract

The presentation of products in our online shop does not constitute a legally binding offer but an invitation to place an order.
By clicking the “Buy now” button, the customer submits a binding order for the items contained in the shopping cart.

After placing an order, the customer will receive an automatic order confirmation via e-mail. This confirmation does not yet constitute acceptance of the offer.
A purchase contract is only concluded when we send a shipping confirmation or dispatch the ordered goods.

3. Vertragsabschluss

Die Darstellung der Produkte im Online-Shop stellt kein rechtlich bindendes Angebot dar, sondern eine unverbindliche Aufforderung zur Bestellung.
Durch Anklicken des Buttons „Jetzt kaufen“ gibt der Kunde ein verbindliches Angebot zum Kauf der im Warenkorb enthaltenen Artikel ab.

Nach Absenden der Bestellung erhält der Kunde eine automatische Eingangsbestätigung per E-Mail. Diese Bestätigung stellt noch keine Annahme des Angebots dar.
Der Kaufvertrag kommt erst mit der Versandbestätigung oder dem tatsächlichen Versand der Ware zustande.

4. Prices and Shipping Costs

All prices are stated in Euro (EUR) and include applicable VAT (if applicable in your country).
Shipping costs are automatically calculated at checkout based on the customer’s location, product type, and weight.

Additional customs duties, import taxes, or fees may apply to international deliveries and must be borne by the buyer.

4. Preise und Versandkosten

Alle Preise sind in Euro (EUR) angegeben und enthalten die gesetzliche Mehrwertsteuer (sofern anwendbar).
Die Versandkosten werden beim Checkout automatisch berechnet, abhängig von Standort, Produktart und Gewicht.

Bei internationalen Lieferungen können zusätzliche Zölle, Steuern oder Gebühren anfallen, die vom Käufer zu tragen sind.

5. Shipping and Delivery

We ship worldwide. 🌍

  • Textiles (T-shirts, hoodies, etc.) are produced and shipped by our print partners located in Europe and the USA, depending on the customer’s region.

  • CDs, vinyls, and jewelry are shipped directly from Germany via DHL.

If both textiles and other items (like CDs or vinyls) are ordered together, the customer will receive two separate parcels.
All shipments include a tracking code.

Delivery times vary depending on destination and product type. Any stated delivery times are approximate and non-binding.

5. Versand und Lieferung

Wir liefern weltweit. 🌍

  • Textilien (T-Shirts, Hoodies usw.) werden von unseren Druck- und Versandpartnern in Europa und den USA je nach Region versendet.

  • CDs, Vinyls und Schmuck werden direkt aus Deutschland mit DHL verschickt.

Wenn Textilien und andere Artikel (wie CDs oder Vinyls) zusammen bestellt werden, erhält der Kunde zwei separate Sendungen.
Alle Sendungen enthalten einen Tracking-Code.

Lieferzeiten variieren je nach Zielland und Produktart. Angegebene Lieferzeiten sind unverbindlich.

6. Payment

We offer several secure payment methods (e.g., PayPal, credit card, instant transfer, or other regionally available options).
Payment is processed immediately upon completion of the order.

6. Zahlung

Wir bieten verschiedene sichere Zahlungsmethoden an (z. B. PayPal, Kreditkarte, Sofortüberweisung oder andere regional verfügbare Optionen).
Die Zahlung erfolgt unmittelbar bei Abschluss der Bestellung.

7. Retention of Title

The goods remain the property of DarkMerch until full payment has been received.

7. Eigentumsvorbehalt

Die Ware bleibt bis zur vollständigen Bezahlung Eigentum von DarkMerch.

8. Right of Withdrawal (Returns for Consumers)

Consumers within the meaning of EU Directive 2011/83/EU have the right to withdraw from this contract within 14 days without giving any reason.

Withdrawal period:
The period begins on the day the customer or a third party designated by them (other than the carrier) takes possession of the goods.

To exercise the right of withdrawal, the customer must send a clear statement by e-mail to info@darkmerch.com indicating their decision to withdraw from the purchase. We will then provide the return address and further instructions.

Exclusions from the right of withdrawal:

All textile products offered in our shop — including, but not limited to, T-shirts, zip hoodies, hoodies, beanies, caps, pants, and bags — as well as selected accessories such as mugs, phone cases, and similar items, are produced individually on demand.

As these products are custom-made specifically for each order, they are non-refundable and cannot be exchanged, except in cases of manufacturing defects or incorrect items delivered.

The sizing information provided for all textile products corresponds to the official measurements supplied by the respective brand or manufacturer. We strongly recommend checking these measurements carefully before placing your order.

Please make sure to review all product details and your order thoroughly before completing your purchase.

No Returns or Exchanges:

  • Items made to the customer’s specifications or clearly personalized (e.g., printed on demand or custom-made textiles).

  • Opened or used data carriers (CDs, vinyls, etc.).

  • Jewelry, underwear, and hygiene items once the packaging has been opened.

Consequences of withdrawal:
If you withdraw from this contract, we will refund all payments received (excluding shipping costs, if applicable) within 14 days of receiving the returned goods.
Refunds will be made using the same payment method used for the original transaction unless otherwise agreed.

➡️ Return shipping costs are the responsibility of the buyer.

8. Widerrufsrecht (Rückgaberecht für Verbraucher)

Verbraucher im Sinne der EU-Richtlinie 2011/83/EU haben das Recht, den Kaufvertrag innerhalb von 14 Tagen ohne Angabe von Gründen zu widerrufen.

Widerrufsfrist:
Die Frist beginnt an dem Tag, an dem der Kunde oder ein von ihm benannter Dritter (nicht der Beförderer) die Ware erhalten hat.

Zur Ausübung des Widerrufsrechts muss der Kunde eine eindeutige Erklärung per E-Mail an info@darkmerch.com senden.
Nach Erhalt teilen wir die Rücksendeadresse und weitere Anweisungen mit.

Alle in unserem Shop angebotenen Textilprodukte — einschließlich, aber nicht beschränkt auf T-Shirts, Zip-Hoodies, Hoodies, Beanies, Caps, Hosen und Taschen — sowie ausgewählte Accessoires wie Tassen, Handyhüllen und ähnliche Artikel werden individuell auf Bestellung (Print-on-Demand) hergestellt.

Da diese Produkte speziell für jede Bestellung angefertigt werden, sind sie von Rückgabe und Umtausch ausgeschlossen, es sei denn, es liegt ein Herstellungsfehler vor oder es wurde ein falscher Artikel geliefert.

Die angegebenen Größeninformationen für alle Textilprodukte entsprechen den offiziellen Maßangaben des jeweiligen Herstellers bzw. der Marke. Wir empfehlen dringend, diese vor der Bestellung sorgfältig zu überprüfen.

Bitte stellen Sie sicher, dass Sie alle Produktdetails sowie Ihre Bestellung vor Abschluss des Kaufs sorgfältig prüfen.

Vom Widerrufsrecht ausgeschlossen sind:

  • Waren, die nach Kundenspezifikation angefertigt werden oder eindeutig personalisiert sind (z. B. Print-on-Demand-Produkte oder individuell gefertigte Textilien).
  • Entsiegelte Datenträger (z. B. CDs, Vinyls etc.).
  • Schmuck, Unterwäsche sowie Hygieneartikel, sofern deren Versiegelung nach der Lieferung entfernt wurde.

Folgen des Widerrufs:
Nach einem fristgerechten Widerruf erstatten wir alle Zahlungen (abzüglich Versandkosten, falls zutreffend) innerhalb von 14 Tagen nach Eingang der retournierten Ware.
Die Rückzahlung erfolgt über dasselbe Zahlungsmittel, das bei der ursprünglichen Transaktion verwendet wurde, sofern nichts anderes vereinbart wurde.

➡️ Die Rücksendekosten trägt der Käufer.

9. Warranty

The statutory warranty rights of France and the European Union apply.
In case of visible defects, the customer must notify us within 7 days of receiving the goods.

9. Gewährleistung

Es gelten die gesetzlichen Gewährleistungsrechte nach französischem und europäischem Recht.
Bei offensichtlichen Mängeln muss uns der Kunde innerhalb von 7 Tagen nach Erhalt der Ware informieren.

10. Liability

We are liable without limitation for intent and gross negligence.
For cases of slight negligence, we are only liable in the event of a breach of essential contractual obligations (cardinal duties).
Liability for indirect or consequential damages, including loss of profit, is excluded to the extent permitted by law.

10. Haftung

Wir haften uneingeschränkt für Vorsatz und grobe Fahrlässigkeit.
Bei leichter Fahrlässigkeit haften wir nur bei Verletzung wesentlicher Vertragspflichten (Kardinalpflichten).
Die Haftung für indirekte Schäden, Folgeschäden oder entgangenen Gewinn ist – soweit gesetzlich zulässig – ausgeschlossen.

11. Applicable Law and Jurisdiction

All contracts are subject to the laws of France, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).
Place of jurisdiction, where legally permissible, is Mulhouse, France.

11. Anwendbares Recht und Gerichtsstand

Es gilt das Recht der Französischen Republik, unter Ausschluss des UN-Kaufrechts (CISG).
Gerichtsstand – soweit gesetzlich zulässig – ist Mulhouse, Frankreich.

12. Online Dispute Resolution

The European Commission provides a platform for online dispute resolution (ODR):

We are not obliged or willing to participate in dispute resolution proceedings before a consumer arbitration board.
